I. Basic Provisions

1. The personal data administrator according to Article 4, Point 7 of the Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter referred to as "GDPR") is MONTECO s.r.o., Mladoboleslavská 676, Vinoř, 19017 Praha 9, Company ID: 25271962 (hereinafter referred to as "administrator").

Personal data refers to any information about an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, particularly by reference to an identifier such as a name, identification number, location data, online identifier, or one or more factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person.

4. The administrator has not appointed a Data Protection Officer.

II. Legal Grounds for Personal Data Processing

1. The legal ground for processing personal data is the performance of a contract between you and the administrator under Article 6(1)(b) GDPR (hereinafter referred to as "Contract Performance") – processing is necessary for the performance of a contract to which the data subject is a party or to take steps at the request of the data subject prior to entering into a contract.

2. The administrator does not engage in automated individual decision-making as defined by Article 22 GDPR.

1. The administrator retains personal data:

   • In the case of an inquiry, personal data included in the form is only processed for the purpose of answering or handling your inquiry/request (only for the duration of contract negotiations), for a maximum of 1 year from your inquiry, unless you provide consent for further processing.

   • In the case of an order, for the duration necessary to exercise rights and obligations arising from the contractual relationship between you and the administrator, and to assert claims from such contractual relationships (for 15 years after the termination of the contractual relationship).

2. After the expiration of the retention period, the administrator will delete personal data.

V. Recipients of Personal Data (Subcontractors of the Administrator)

1. The recipients of personal data are individuals:

   • Providing website/e-commerce operation services (Alexandr Zlesák, DiS. - AZ Computers, Company ID: 70163278) and other services related to the operation of the website/e-commerce.

   • Personal data of the data subject may be provided to delivery service providers and other individuals providing legal, accounting, and IT services to the administrator to ensure compliance with legal obligations. The administrator does not intend to transfer personal data to a third country, international organization, or other third parties except those mentioned above.

VI. Your Rights

1. Under the conditions set forth in the GDPR, you have:

   • The right to access your personal data under Article 15 GDPR,

   • The right to rectification of personal data under Article 16 GDPR, or restriction of processing under Article 18 GDPR,

   • The right to erasure of personal data under Article 17 GDPR,

   • The right to object to processing under Article 21 GDPR, and

   • The right to data portability under Article 20 GDPR.

2. You also have the right to file a complaint with the Data Protection Authority if you believe that your right to data protection has been violated.

VII. Data Security Conditions

1. The administrator declares that all appropriate technical and organizational measures have been taken to secure personal data.

2. The administrator has implemented technical measures to secure data storage and personal data storage in paper form, including passwords, antivirus software, backups, and locking.

3. The administrator declares that only authorized persons have access to personal data.

VIII. Final Provisions

1. By submitting an order through the online order form or an inquiry through the online inquiry form, you confirm that you have been informed about the privacy policy and that you fully accept it.

2. The administrator reserves the right to change these terms. The new version of the privacy policy will be published on its website.

These terms are effective as of 01.01.2025.
